What is an Industrial Design?
An Industrial design or a model is the external design or the appearance of the whole or part of a product, which arises from its particular characteristics, such as, for example:
- outline;
- shape;
- form;
- colours;
- line;
- texture;
- materials of the actual product;
- its decoration.
It is noted that natural products, ideas, sounds, music and scents do not constitute design or model.
The filing of an industrial design constitutes a form of intellectual property, which the holder may use, assign or license.
It is also noted, that an industrial design or model neither protects the way in which a product operates nor can it be invoked for purposes of differentiating one enterprise from another. If you wish to protect the way your product operates or to protect your design or model as a distinctive part of your enterprise or products/services, you may proceed through other forms of intellectual property rights (e.g. trademarks, patents etc.).
