Reinstatement of Trademark

In case of termination of protection of a registered trademark due to its no timely renewal, the trademark beneficiary may request within twelve (12) months of the expiry date of its last ten-year protection period, the reinstatement and restoration of their rights, provided that even though the same has shown all due diligence under the circumstances, they could not comply with the renewal deadline, due to:

  • force majeure;
  • random unpredictable event; or
  • other significant reason outside their responsibility.

Filing of application

You may submit an application for reinstatement of things to an earlier state in relation to your trademark that has expired due to non-renewal, by submitting the form Ε.Σ. 12, through the  trademark's e-filing system or by hand/post, accompanied by the fee of seventy euros (€70), as well as the forms and fees related the renewal. In case you havent submit the forms and fees related to the renewal and the request to return things to the previous state is accepted, then you will be asked to submit them within one month of approval.

The fees are payable in cash, by cheque, through an account maintained with the Department of Registrar Companies and Intellectual Property or through bank transfer.

If you are a registered user you may proceed with the electronic registration of the form, otherwise you must first obtain access to the electronic trademark registration.
