Converting European trademark into national

Applying for conversion

The conversion application is submitted to the EUIPO within a period of three (3) months, the commencement of which depends on the grounds for conversion. The deadline is not extendable.

The EUIPO, upon examining the conversion application and deciding to accept it, notifies the national offices, by a letter accompanied by the relevant documents, to proceed with the conversion according to the national legislation of each office.

Following the receipt of the relevant notification from the EUIPO, accompanied by the conversion documents, the Intellectual Property Section:

  • notifies the applicant to appoint a lawyer in the Republic of Cyprus and to submit, by hand / post, the national application for trademark registration (form Ε.Σ. 02), accompanied by the translation of conversion documents into the Greek language or
  • In case where a lawyer appointed in the Republic of Cyprus is already mentioned in the conversion documents, the Intellectual Property Section notifies directly the appointed lawyer to submit, by hand / post, the national application for trademark registration (form Ε.Σ. 02), accompanied by the translation of the conversion documents into the Greek language.

In case where the conditions for filing a conversion of your European trademark into national trademark are not met, the Intellectual Property Section notifies you accordingly and calls you to take corrective actions.

Provided that the Section is satisfied that all formal requirements are met in relation to the said application, it proceeds with the substantive examination of the application on the basis of the procedure followed during the examination of national application for trademark registration.

In the event that the conversion application is accepted and the mark is entered into the national trademark register, the entry date of the trademark into the national register reverts back to trademark's submission date to the EUIPO or, where applicable, the priority date claimed before the EUIPO.
