Managing a trademark as a property object

Grant, amendment or annulment of licence of use

Following the submission of registration application or the trademark's registration, the applicant or the registered beneficiary may grant licence of use for the trademark's application or the registered trademark, respectively, to a third person.

The said licence of use may:

  • be exclusive or not;
  • be granted for indefinite or definite duration;
  • concern a national or international trademark with validity, or application for validity, in the Republic of Cyprus;
  • concern part or all of the products or services;
  • cover the entire or part of the Republic of Cyprus' territory.

The applicant or the registered beneficiary must notify to the Intellectual Property Section the grant of licence of use by submitting form Ε.Σ 10. Subsequently, the trademarks register must be updated in relation to the amendment or the striking-off of the said grant.

Filing the licence of use

You may submit an application for filing alterations to the register (form Ε.Σ 10), by hand / post, accompanied by:

  • sufficient documents evidencing, depending on the case, the grant, amendment or termination of the licence of use;
  • the agreement granting licence of use (in case of relevant filing);
  • certified translation of the said documents or agreement in the Greek language in case where the original is in another language;
  • the fee of one hundred and eighteen euro (€118) for the first class and twenty six euro (€26) for every additional class. 

The fees above are payable in cash, by cheque, directly from an account you maintain in the Department of Registrar of Companies and Intellectual Property, or by bank order.

In case where the conditions for the filing of transfer are not met, the Section informs you accordingly and requests that you take corrective actions within two (2) months. In case of non-compliance, the application is dismissed.

Provided that the Intellectual Property Section is satisfied that no apparent risk of misleading the public arises, particularly as to the nature, quality or geographic origin of the product or service and that all, depending on the case, legal requirements have been met, it proceeds with the filing of the grand, amendment or strike-off of the licence of use with the trademarks register.
