Granting a National Patent

Patent Certificate

Proof of receipt of documents

After the receipt of your application, the Intellectual Property Section issues the relevant proof of receipt and notifies you of the relevant application number and date.

Typical examination

The examination stage follows, during which the Section examines whether the application meets the typical requirements set by the legislation as to information, data and documents that must be included in it. If there are any pending issues, the Department will send you a relevant notice, notifying you to take the necessary actions in relation to your application.

Patentability investigation

Provided that your application has passed the typical examination stage, the Department notifies the applicant to obtain and submit, within 16 months of the application date (or the priority date, where claimed), an investigation report by a recognised International Patent Examination Office.

In case where the applicant chooses the European Patent Office (EPO), a certified translation of all documents in the English, French or German language, either by an affidavit or by sworn translator  of the Republic of Cyprus, is submitted accompanied by a fee of two thousand four hundred and eighty-eight euro (€2488) to the cashiers office of the Registrar of Companies and Intellectual Property, which undertakes the transmission of the request for investigation to the EPO.

Upon receipt of the investigation report by the EPO or a recognised International Patent Examination Office, the report is submitted to and filed with the Registrar of Companies and Intellectual Property.

Issuance of Patent Certificate

Provided that the invention is patentable and the fee of one hundred and thirty euro (€130) is paid, the Registrar of Companies and Intellectual Property issues the Patent Certificate and proceeds to its publication in the Official Gazette.

Certified Copies
In case you wish to secure the issuance of certified copies of an application for granting a patent or of a granted patent, you can submit a request for obtaining certified copies of patent.
