Registering a National Trademark
Applying for national trademark
Once you are satisfied that your mark meets all the prerequisites for protection and provided you have made an availability check among the registered trademarks and the applications for trademark registration, you can proceed with the submission of an application for its registration in the Republic of Cyprus.
Submission of application
You can submit the application for registration of national trademark (form Ε.Σ 02), either through the trademark's e-filing system or by hand / post, accompanied by:
- representation of the mark in case it is not word trademark;
- in case where priority is claimed, the following are attached:
- statement regarding the date and the country of earlier filing;
- certified copy of the earlier filing or certificate of filing by the competent authority;
- certified translation in the Greek language of the priority documents;
- in case of submitting the application for trademark's registration, either by hand/ post or electronically, the fee of one hundred forty one euro (€141) or the fee of one hundred twenty nine euro (€129), is paid respectively. Additionally, the fee of one hundred and two euro (€102) or ninety four euro (€94) for every class of products and services beyond the first one, is paid, in case of submission by hand/post or electronically, respectively.
- in case where the application concerns the registration of certification or collective trademark, the regulation of use of the said trademarks is also submitted and the fee of four hundred and fourty three euro (€443) or four hundred and fifteen euro (€415) is paid, in case of submission by hand/ post or electronically, respectively. Additionally, the fee of one hundred and twenty eight euro (€128) or one hundred and sixteen euro for every class of products and services beyond the first one, is paid in case of submission by hand/post or electronically, respectively.
It is noted that the fees are payable depending on the manner of submission of the form:
- by credit card in case of electronic submission;
- in cash, by cheque, through an account in the Department of Registrar of Companies and Intellectual Property or through bank transfer, in case of submission by hand/post.
It is highlighted, that on the basis of the Trademarks Law, as of 18/06/2020, it is possible to submit an application for the registration of a trademark with multiple classes on the same form. For each class, the reference to products and services shall be made by using the Nice classification.
If you are a registered user, you can proceed with the electronic submission of an application for trademark registration, otherwise you must first obtain access to the trademarks' e-filing system.
