Main criteria of review of an application for the assignment of patent rights

The main criteria of review for the assignment of patent rights are:
- submission of form Π.3;
- payment of fee;
- assignment / transfer agreement which must include:
- names and addresses of the parties;
- reference to the patent for which the assignment is taking place;
- assignment / merger date;
- signatures of the parties.
Important notice: if the transfer date is within 9 months from the date that the patent is granted in EPO diploma, the EPO Form 2544 form which replaces the agreement may be accepted.
- in case where the agreement is not a true copy, it must be accompanied and certified by a Competent Authority as a true copy;
- certified translation of the agreement, if it is in a language other than Greek, either by a affidavit or by a sworn translator of the Republic of Cyprus;
- power of attorney (form Π.8) from the Assignee.
Most common reasons for rejection of forms
- failure to submit a transfer agreement or EPO form 2544;
- failure to submit the power of attorney by form Π.8 by the Assignee.
It is noted that in case of omission of completion / submission of the above data / documents, a relevant letter is sent for submission of the data that are missing within a specified period.
