Fill in and submit form Ε.Σ.18, within two (2) months from the date of notification by the Intellectual Property Section, to request that the objector, or the applicant of invalidity,  to prove that he has made, during the five year period preceding the date of application for registration or the priority date, substantial use, or the existence of reasonable cause for non-use, of a previous trademark.

In particular, the applicant for a trademark registration or the beneficiary of registered trademark, in case of objection to trademark registration or an application for the invalididty of a registered trademark respectively, may submit the form, provided that following are fulfilled:

• the objection or the application, respectively, is based on the use of a previous registered trademark;
• the period of use of a previous trademark is at least five years from the submission date or its priority date; and
• the objector has not produced evidence of use.

It is noted that no fees are paid with the submission of the form.
